Pretty bad reporting by James Cowan from the Putz: link

Kenneth Lay, the disgraced chief executive of Enron, remained free following his fraud conviction in 2006. Media doyenne Martha Stewart also avoided jail after she was found guilty of obstructing justice in 2004. In both cases, the defendants avoided prison even after sentencing as they appealed their convictions. Lord Black also intends to appeal, but in his case it is unlikely to delay imprisonment, said Peter Henning, a law professor at Wayne State university.

Kenneth Lay died of a heart attack three months before his sentencing hearing. Because he took the Serbian exit he never served a day in jail.

And when Martha Stewart was sentenced she agreed to begin serving a five-month prison term while her appeal was still pending.
